Limited Warranty
Hermle makes the following limited warranties. These limited warranties extend to the original consumer purchaser or any person receiving this product as a gift from the original consumer purchaser to and to no other purchaser or transferee (the *Consumer').
Hermle warrants to the Consumer that the movement and accompanying components will be free of defects in material and workmanship for a period of THREE YEARS from the date of the original retail purchase of FIVE YEARS from the date of manufacture, whichever date occurs first.
The obligation of Hermle under these warranties is limited to repair or replacement, at Hermle's discretion, of this product.
All warranty repairs must be brought to the point of sale and all products must be returned within the original carton to eliminate damage during the return transportation.
Exclusions to this limited warranty are following:
1. Unauthorized repairs
2. Mishandling of the product
3. Abuse and/or misuse of the product
4. Modifications to the product/components
5. Damage to the products and/or its components
6. Damage beyond regular use
7. Damage by environmental situations and/'or changes of climate
8. Transportation damage, accidents, or any acts by God.
ALL WARRANTIES IMPLIED BY APPLICABLE LAW, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY LIMITED TO THE DURATION OF THE LIMITED WARRANTIES SET FORTH ABOVE.
Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
WITH THE EXCEPTION OF ANY WARRANTIES, GUARANTEES AND AGREEMENTS AND SIMILAR OBLIGATIONS OF HERMLE OR SELLER IMPLIED BY STATE LAW AS HEREBY LIMITED, THE FOREGOING EXPRESS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, GUARANTEES, AGREEMENTS AND SIMILAR OBLIGATIONS OF HERMLE OR SELLER WITH RESPECT TO THE REPAIR OR REPLACEMENT OF ANY PRODUCT OR PARTS.
IN NO EVENT SHALL HERMLE BE LIABLE FOR INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES, WHETHER ARISING IN CONTRACT OR TORT.
Some states or provinces do not allow the exclusion or limitation of incidental or consequential damages so the above limitation may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights which vary by state or province.
